Functional designs

A functional design protects features where the shape or configuration is linked to how the article works. Functional designs must generally be new and not commonplace. They are different from patents because the focus is on the design features of an article rather than the broader inventive concept.

Lifespan and document preparation

In South Africa, aesthetic designs can be protected for up to 15 years and functional designs for up to 10 years, subject to renewal requirements. Good drawings, product images, descriptions, ownership details, and filing records are important when preparing a design application.
